Part 74 Licensing: Almost No Church Needs One

Almost no church needs a Part 74 licence. Nearly every congregation operates unlicensed under Part 15, which is entirely lawful. Part 74 eligibility is narrow, and the category that could conceivably reach a church covers entities routinely using 50 or more wireless microphones.

Two things get confused constantly, and confusing them costs churches either money or confidence. The first is that operating without a licence is somehow a loophole or a risk. It is not: unlicensed operation under Part 15 is the intended, lawful route for the overwhelming majority of wireless microphone users. The second is that a licence would solve an interference problem. Usually it would not. What the two routes actually differ on

A licence changes three things: your permitted power, your ability to register operations for protection, and your obligations. It changes nothing about where you may transmit. A licensee may not sit on top of a local television station any more than an unlicensed church may.

A Part 74 licence raises UHF power from 50 mW to 250 mW and allows registration for protection, but does not change which television channels you may use.

The power difference looks large and is about 7 dB, which is roughly a doubling of free field distance. At church distances the binding constraint is far more often antenna placement than transmitter power.

Who is actually eligible

Eligibility for a low power auxiliary station licence is set by category, not by need or by good intentions. The traditional categories are broadcasters and broadcast network entities, cable television operators, and motion picture and television programme producers. A church is none of those in the ordinary case. The category that could conceivably reach a very large church is the provision covering entities that routinely use large numbers of wireless microphones, with 50 or more being the figure the rules turn on.

That figure is worth sitting with, because it is a long way from where churches live. A 1,000 seat church with a full band, a choir and multiple speaking positions is typically coordinating somewhere between twelve and twenty frequencies including its in-ear packs. Fifty or more simultaneous wireless devices, routinely, describes a large touring production or a major performing arts venue. If your church genuinely operates at that scale, or runs a licensed broadcast facility or a commercially rented auditorium, the question is worth putting to the FCC or to a professional frequency coordinator rather than settling from a web page.

What a licence would and would not fix

Churches usually reach for the idea of a licence when something has gone wrong. It is worth being precise about which problems it touches, because in most cases the answer is none of them.

A Part 74 licence addresses none of the four failures that actually account for most church wireless trouble.

The last row is the one genuine benefit, and it matters for a large scheduled production in a dense market rather than for a Sunday service.

What to do instead, in order

  1. Fix the antennas first. Receiver antennas need line of sight to the platform. Getting them out from behind a closed rack door recovers more usable range than the entire difference between 50 mW and 250 mW would.
  2. Write the frequency plan down. Frequency, channel name, transmitter serial and the position it serves, taped inside the rack door. A plan that lives only in one volunteer memory is a plan that leaves when they do.
  3. Count the in-ear packs in the same plan. In-ear monitor transmitters use the same spectrum as the microphones. Leaving them out of the count is the commonest way a plan quietly runs out of room.
  4. Move to digital before you add channels. Digital systems roughly double what fits in each open television channel. That is a bigger gain than any power increase and it needs no application.
  5. Scan again whenever anything changes. A new television station, a neighbouring venue installing wireless, or a visiting band with their own systems all invalidate the plan. Re-scan before the service.

Systems that reduce the coordination burden

If the underlying worry is that nobody on the volunteer rota wants to own a frequency plan, the answer is a system that manages its own frequencies rather than a licence. That is a genuine solution to the real problem.

Not on its own, since the figure the rules turn on for that eligibility category is 50 or more routinely used devices. Twenty channels is a serious coordination job but it is well inside what unlicensed operation handles. Spend the effort on moving to digital, which roughly doubles density, and on a written plan that includes the in-ear transmitters.

Would a licence let us use the 600 MHz band?

No. The 617 to 652 MHz and 663 to 698 MHz blocks were auctioned to mobile carriers and are closed to wireless microphones entirely, licensed or not. No licence, waiver or power level makes them available. The same is true of television channel 37 at 608 to 614 MHz and of the 700 MHz band above 698 MHz.

How much more range does 250 mW give over 50 mW?

About 7 dB, which is roughly a doubling of free field distance. That sounds decisive and rarely is, because church wireless failures are almost always caused by the receiver antenna being inside a closed rack or behind a screen. Fix the antenna path first and the power question usually stops being interesting.
